1. Program Overview
Wirks Communities is a referral-based fundraising program offered by Wirks Moving & Storage ("Wirks"). Participating community groups, teams, schools, churches, and nonprofit organizations ("Group") receive a dedicated phone number and tracking link to share with their community. Wirks will pay Group 5% of the revenue from qualifying moves booked using that number or link, subject to these terms.
2. Eligibility
Participation is open to community organizations located in or serving the Atlanta metro area, at Wirks' discretion. Wirks reserves the right to approve, deny, or remove any group from the program at any time.
3. Qualifying Bookings
A booking qualifies for the revenue share only if it is made using the Group's assigned tracking number or link, and only if the move is completed and paid in full. Revenue share is calculated on actual collected revenue, not on quoted or estimated amounts. Wirks' tracking and booking records are the sole source used to determine qualifying bookings.
4. Payment
Payments are calculated and issued quarterly, based on qualifying bookings completed during that quarter. Payments will be sent to the payment destination provided by Group on its enrollment form. Group is responsible for keeping payment information current and notifying Wirks of any changes. Wirks is not responsible for payments sent to outdated or incorrect information provided by Group. Group must complete and submit a Form W-9 prior to receiving any payment under this program. Wirks may withhold payment until a valid W-9 is on file.
5. Banner Deposit
Groups requesting an event banner will be charged a $25 deposit at setup. This deposit is credited back to Group in its first quarterly payout. The deposit is non-refundable if Group generates no qualifying bookings.
6. No Guarantee of Earnings
Wirks makes no guarantee regarding the number of bookings, amount of revenue, or size of any payout Group may receive through this program. Participation does not create any minimum payment obligation on the part of Wirks.
7. Relationship of the Parties
Group is not an employee, agent, partner, or franchisee of Wirks. Group has no authority to make representations, commitments, or agreements on behalf of Wirks. Group may not represent itself as an official Wirks location or authorized reseller.
8. Marketing Materials
Wirks will provide Group with a co-branded flyer and, if requested, a co-branded banner. Group may share these materials, along with its assigned number and link, through social media, print, or word of mouth. Group agrees not to alter the materials in a way that misrepresents Wirks' services or pricing.
9. Prohibited Conduct
Group's tracking number or link may be used for bookings made by Group's own members, including self-booked moves, and such bookings qualify for the revenue share like any other. Group may not engage in fraudulent or misleading conduct in connection with the program, including misrepresenting Wirks' services, pricing, or the nature of the program to generate bookings. Wirks reserves the right to withhold payment and/or terminate participation for any violation of this section.
10. Tax Responsibility
Group is solely responsible for determining and complying with any tax reporting or payment obligations related to funds received through this program. Wirks may issue tax documentation as required by law based on the total amount paid to Group in a calendar year.
11. Term and Termination
Either party may terminate participation in this program at any time, for any reason, with or without notice. Upon termination, Group's tracking number and link will be deactivated, and Group will receive payment for any qualifying bookings completed prior to termination, paid on the next regular quarterly cycle.
12. Changes to the Program
Wirks reserves the right to modify, suspend, or discontinue the Wirks Communities program, including the revenue share percentage, payout schedule, or these terms, at any time. Material changes will be communicated to active participating groups.
13. Limitation of Liability
Wirks' total liability to Group under this program is limited to the amount actually owed to Group under Section 4. Wirks is not liable for any indirect, incidental, or consequential damages arising from participation in the program.
